What is a traffic ticket?

A traffic ticket is a citation or summons issued to a person who has violated a motor vehicle law in the state of Texas. An example of this violation would be a speeding ticket or getting a ticket for running a stop sign. The traffic ticket, which is issued by a police officer or other authorized representatives of the government, is an order to appear in court before a judge.

 

Should I pay my ticket?

No!!! There are often many hidden penalties in addition to paying the fine. 
Simply paying the ticket is an admission of guilt and results in the highest fine as well as a stain on your driving record.  Also, paying a traffic ticket may result in the suspension of your drivers license, the loss of driving privileges, or expensive surcharges.  Convictions on your driving record can make your insurance rates go up substantially. In Harris County, Texas a single ticket has the potential to raise your automobile insurance rate by $1,200 per year for three years. That is an increase of $3,600 for paying one ticket!  By simply paying your traffic ticket, your insurance rates may be increased over the next three to five years!

 

What happens if I fail to appear in court?

Failure to appear in court can and probably will result in the issuance of a warrant for your arrest and a new charge of “Failure to Appear” being filed against you.

 

Do I need a lawyer for traffic violations?

Defending yourself in court can be complicated and traffic tickets can have serious consequences. While most traffic tickets are just "violations" under Texas law, many people don't understand that some traffic ticket violations are actually criminal charges such as driving a vehicle while your license was suspended. A suspension can happen when you have several minor tickets or just one very serious ticket. Many motorists have their license suspended simply because they failed to respond to the traffic ticket court date and don't know what to do when it becomes a problem years later.

If you are convicted, you will pay fines, you may have points put on your license, you may face suspension or even revocation of your license, not to mention increased payments to your auto insurance company.

Most people do not have the time to spend in a Texas traffic court and regard the attorney fee as money well spent.

 

Is signing the ticket an admission of guilt?


No, it's just your acknowledgment of receipt of the notice to appear. Because you are actually being charged with a violation of law, the officer could take you into custody if you refuse to sign the ticket. But, by signing the traffic ticket, you avoid being taken into custody and are actually released on your own recognizance pending the court date. It's in your best interest to sign the ticket, so you remain free and retain your right to show up at the court hearing to dispute it or otherwise resolve the matter.

What is the Texas Points System?

New Texas laws went into effect on September 1, 2003.  Certain traffic convictions will cause "points" to accrue against you.  For example, "moving violation" convictions will result in two points being credited toward your driving record.  Three points will be credited if the violation resulted in an accident.  As a result, insurance companies will use these convictions to increase your insurance rates and under certain circumstances this can lead to suspension of your drivers license.

Additionally, the Texas Department of Public Safety will assess a yearly "surcharge" on the drivers license of anyone who has accumulated six or more points during the preceding thirty-six months.  The surcharge is $100 for the first six points, and $25 for each additional point.  For each conviction of driving without your license, the surcharge is $100.  If you are convicted of driving with an invalid license, a suspended license, or for "no insurance", the surcharge is $250.
